q   The execution of Mobile Home Bill of Sale has to be attested by a solicitor of the Supreme Court, and the attestation shall state that before the execution of the Mobile Home Bill of Sale that the effect thereof has been explained to the Seller by the attesting solicitor

q   The Mobile Home Bill of Sale is void unless attested and registered. It has to be registered under the Bill of Sales Act 1878 within seven days after the execution of Mobile Bill of Sale

q   To register the Mobile Home Bill of Sale check with your local authorities.

q   Seller(s) should provide the name of any lien holder(s) where appropriate.

q   Buyer should make sure that there are no liens (by lenders, lien holders, etc.) on the mobile home that have not been disclosed by Seller.

It can help both the Seller and Buyer to protect their rights and is useful to both for tax and other accounting purposes. A Mobile Home Bill of Sale can also help the Buyer prove that he/she owns the mobile home.

   However, a Mobile Home Bill of Sale is not always sufficient, by itself, to complete the sale and transfer of a mobile home. The mobile homes Certificate of Title may also have to be signed over by the Seller.

   With this form, the mobile home can be sold “As Is”, without any type of express or implied warranty or with a warranty.

   The purchase of mobile homes has increased over the years. They are popular often because of their affordability. There are many advantages to purchasing a mobile home -- lower price, affordable payments, less property tax, cheaper repair and maintenance costs.    Depreciation is something to be aware of for both buyer and seller.  There is a common perception that mobile homes only go down in value and are rarely sold for a profit.  This is not the case, particularly if the home is attached to real estate.  There is a much better chance of reselling a mobile home at a profit if there is real estate involved.

Introduction:  Legal consideration is the exchange of something of value between the parties that must be present to have a valid, legal agreement. Here, fill in the amount of money (consideration) that the mobile home will be purchased for. Fill in the Sellers name and address.  Fill in the Buyers name and address.  The Consumer Credit Act must be complied with when the consideration is under £25,000.

 Fill in the details about the mobile home as indicated, including make, model, size, year, mileage and serial number. Fill in the current location of the mobile home.

 The mobile home will be sold with all fixtures, accessories and equipment except those listed here.  Fixtures are considered part of the structure that are permanently in place. They usually cannot be removed without damage to the premises.  List anything that the Seller will specifically remove prior to the sale.

 Seller warrants that the mobile home is free of encumbrances. If there are any, list in the space provided or mark “not applicable.

Seller warrants that he/she is the legal owner of the mobile home.

Seller will defend against any claims or demands.

 Check whether the mobile home will be sold “as is” or with specific warranties. Purchasing a mobile home “as is,” of course, means the mobile home will be purchased just as it is at the time of sale with no improvements or repairs.  This is a “buyer beware” scenario where it is up to the Buyer to do their homework prior to purchasing the home.

Signature Block:  Date the document. Both Seller (Transferor) and Buyer (Transferee) should sign the document.  This document should be signed in the presence of a Notary.  The Buyer should retain the original document and Seller should keep a copy.
