q   There are two forms in this package: (1) One is a General Affidavit under Oath where the Declarant (the person making the declaration who signs the Affidavit) states certain facts under oath or affirmation; (2) The second form is a General Affidavit before Commissioner of Oaths where the Declarant declares certain facts to be true after taking an oath before the Commissioner of Oaths.

q   Although two forms have been provided, only one of the two forms needs to be used. It is up to the Declarant (i.e. the person signing the affidavit and making the declaration) to decide which form is appropriate and which form to use.

q   The General Affidavit before Commissioner of Oaths should be signed before a Commissioner of Oaths and requires that the Commissioner of Oaths give the Declarant an oath.

Affidavits can be used in numerous ways. The Declarant is stating their personal knowledge of certain facts based on their own information. Affidavits are often used in conjunction with legal documents, purchasing real estate, or even in various business transactions.

Dont let the relative brevity of the form fool you. While the form is short, it carries substantial weight as a legal document.  Affidavits are often used in conjunction with legal proceedings.  The Affidavit is used as a basis for substantiating the facts of a case, or certain business situations. For instance, one might be requested to attest to their companys financial ability to repay a loan, or attest that they are the lawful owner of a piece of property.

It is extremely important that the Declarant be completely truthful when filling out this form.  Because it is a sworn statement it carries the penalty of perjury.  In a litigation setting, it can also be used to impeach a witness.
