Whenever you sell a boat or other type of watercraft, it is a good idea to document the transaction in writing. A Boat/Vessel Bill of Sale, (sometimes know as a Boat or Watercraft Bill of Sale), can be used to document the terms and conditions of such a sale. It can help both the Seller and Buyer to protect their rights and is useful to both for tax and other accounting purposes. A Boat / Vessel Bill of Sale can also help the Buyer prove that he/she owns the boat or watercraft.
The Boat/Vessel Bill of Sale is not always sufficient by itself to complete the sale and transfer of a vessel. If the vessel has any type of “Certificate of Title” it should also be signed over by the Seller and filed with the appropriate state agency.
One important consideration when buying or selling a boat is to ascertain if the boat has ever been fined. Boats are considered independent entities, so if they have ever been fined it stays with the boat and carries over to the new owner. Some of the highest fines are usually a result of the boat causing environmental damage.
Buying a used boat is a “buyer bewares” situation. If you are the purchasing a used boat and are not familiar with what exactly you should be looking for, you can hire a marine surveyor or boat builder to help you.
In a private boat sale the following terms must be present for a valid sale:
• The owner must have the right to sell the boat/vessel.
• The boat should match the description set forth in the Bill of Sale.
• The craft should not be misrepresented in any way.
Once the contract is taken care of, be sure to perform the transfer of title. Just as with a car, even after the contract is signed and the key are handed over, the sale is not complete until the seller signs over ownership. Ask and see the seller’s Bill of Sale from when he originally purchased the boat. Documents that will also prove ownership are insurance policies and boat registration cards. You can cross check the Hull Identification Number against the numbers written on the Seller’s paperwork as well.
It is also possible to search the boat’s title in the state that the boat is registered in. Check with the Maritime and Coast Guard Agency (if the boat is documented) to determine if there are any liens on the boat.
Registration of non-commercial pleasure craft is not compulsory for a UK Citizen who keeps their boat in the UK, but it is essential if you wish to take your boat outside of UK territorial waters.
